Financial Compliance Designed for E-2 Visa Requirements

The E-2 treaty investor visa allows nationals of treaty countries to invest in and operate a business in the United States. Maintaining that visa requires more than running a profitable business. It requires financial documentation that meets specific USCIS standards, records that demonstrate the business is not marginal, and ongoing compliance that can withstand scrutiny during renewal.

Many E-2 visa holders discover too late that their financial records are insufficient for renewal. Incomplete bookkeeping, missing payroll documentation, or financial statements that do not align with original projections can create serious problems during the renewal process. The cost of reconstructing records and addressing deficiencies under time pressure is always higher than maintaining proper compliance from the start.

At Arc & Ledger, we understand the specific financial requirements of the E-2 visa because we serve a community of investors who rely on this program. Our E-2 Investor package is built around the documentation standards that immigration attorneys and USCIS adjudicators expect, and our team coordinates directly with your legal counsel throughout the process.

Why E-2 Compliance Matters

Visa Renewal Depends on Financial Records

USCIS evaluates your business performance against original projections. Clean, consistent financial records are essential for a smooth renewal.

Penalties for Non-Compliance Are Severe

Beyond tax penalties, inadequate financial documentation can result in visa denial, forcing you to leave the country and potentially abandon your investment.

Immigration Attorneys Need Reliable Data

Your attorney builds your case on the financial documents we prepare. Accurate, timely reporting gives your legal team the strongest possible foundation.

Proactive Compliance Costs Less

Maintaining proper records monthly is significantly less expensive than reconstructing years of financial history under the pressure of a renewal deadline.

Source-of-Funds Documentation

An E-2 petition has to show that the money invested is lawfully obtained and that it can be traced, dollar for dollar, from where it came from to the U.S. business account. This is the part applicants most often underestimate. Having the money is not the same as being able to document where it came from, and a gap in the trail is a common reason a case comes back with a request for more evidence.

This is accounting work, not legal work. Your attorney decides what the petition argues and what it needs. We build the financial record underneath it: a schedule that ties every transfer to a documented origin, reconciled against the statements, and handed to your attorney in a form they can file from.

Tracing the money to its origin

Salary and employment records, proceeds from selling a property or a business, accumulated business profits, a gift, an inheritance, or a loan. Each source needs its own documentation, and mixed sources need to be separated rather than presented as one lump sum.

The transfer trail

Statements following the funds from the origin account through any intermediate accounts to the U.S. business account, with the wire records and dates lined up so the path reads in order and nothing appears from nowhere.

Gifts and loans, documented as such

Money from family or a lender needs its own paperwork: who gave it, when, on what terms, and where that person got it. A gift that arrives undocumented tends to become the question the whole case turns on.

Tying it to the opening books

The invested amount has to agree with the opening balance sheet of the business and with what the funds were actually spent on. We reconcile the two so your financial statements and your petition tell the same story.

Source-of-funds work is included in the Initial Business Plan Financials engagement ($2,500) and is available on its own if your attorney only needs the tracing package. Where records are missing or the trail runs through several countries, we will tell you what is reconstructable and what is not before you commit.
